SHOULD HE BE FIRED? HE HAS SERVED OUR COUNTRY! He has a sick wife with cancer. I need 100 answers. Please help?

There is a very nice older man (Est65??) thats works in a school cafeteria at Rockledge High School, in Rockledge Florida. (www.rockledge.brevard.k12.fl.us). He served his time in the military, and has a very sick wife with cancer. He is the only man that works in the cafeteria, and is daily surrounded by at least 15-20 women. They are trying to get him fired, because they say, he gives away too much food. Should he be fired? and what kind of legal action should he take if he is? please answer.

    giving away your employer’s stuff (food) without authorization is stealing. Stealing is wrong no matter how nice you are. Sorry, but he needs to stop.

    The situation with the cafeteria ladies might be a bit more complicated than you think, but whatever the problem is, there ought to be a solution that is kinder than firing!

    You might try talking to a lawyer or find out if there is any state law that might help. Unless he is doing something that the school has rules against then I would have to say no.

    iThe man serves too much food on plates? or does he steal food and give to people? If he puts too much on plates, then is it wasted or eaten?

    I guess there are some directives he could be given and if he continues to disobey directives he is insubordinate and could be fired.

    If there is a union for employees he should get his representative to argue this for him. If he is a civil servant, then he needs to appeal any dismissal before the Civil Service Commission.

    They would be required to give him directives that were disobeyed to fire him. If a child asks for more of something, I think he should give it.

    I do not think that opinions of people across the country could really save him if they gave him proper notice and directives. Further, profanity is never acceptable.

    Yeah, it would really suck if he was fired. But, if they have already told him to knock it off, and he keeps doing it anyway, he is bringing it upon himself. If they havnt warned him, maybe you should so he can stop before its too late.

    I’m the same way…. I’m a giver too…If that’s all they can find wrong with him, couldn’t he get put on a different job rather that get fired?
    As long as every kid that buys a lunch that day gets a portion of whats being served, it’s better than it being thrown away. Right? But if the food is running out then there is a portion problem.

    No, I don’t think he should be fired. At worst give him a chance to stop giving away too much food if this is the problem. Tell him he has to stop doing it or lose his job. If he keeps doing it then I guess he doesn’t care if he gets fired.

    Jobs should be equal… in other words, being a veteran and his wife should really not make a determination.
    It is hard to define "gives away too much food". For example.. the cafeteria may have a budget that is being cut, and they may be FORCED TO SAY "we HAVE to make 5 dollars worth of cookies feed 100 kids". If he is defying the supervisor, that can be a problem, and he should get warning. Follow the rules is important. I admire someone who is generous, but if he makes it hard on the budget or manager, then he has to consider this too.
    IF he is truly being harassed by the other employees.. then someone has to stop that from happening too.
    And.. if the budget only has room for 20 workers and there are 30 workers, then legally, they may not NEED A REASON to let him go.
    Lots of factors involved to think about.

    Who’s in charge? A union? That’s why they’re trying to get him fired, he’s taking a job a union member could have. Or is it the teachers’ union? Maybe he’s teaching the kids the U.S. History the teachers aren’t.

    If it’s a union, they’ll win because union bosses are evil and don’t care about people like this guy and they will persist till the opposition gives up.

    No, don’t fire him.

    As someone who also has cancer (Non-Hodgkin’s Lymphoma - diagnosed in Jan and in remission since Apr), I can tell you that we have been scratching to keep alive. I also have struggles with bills because they won’t give me health care (been stonewalled at every turn…you need THIS document etc) and I’m losing my apt and food stamps. I have no kids so I’m not eligible for housing or cash assistance. I’m 35 years old…I’m too young to die.

    This man is a true American to give back to those of us who are in need. Though he can be fired for what he’s doing, he really shouldn’t be on a moral basis. These women you speak of should put their drama to rest and allow this man to continue serving food to those of us who are struggling to eat. As a cancer patient, I can’t eat much due to the small size my stomach has shrank to, but I also need to eat to regain my strength and muscle structure.

    Do everything in your power to prevent this man from being fired! He is giving back to his community, which far too many people don’t these days. Besides, when I worked in the food industry before I got cancer, much of that food is thrown away at the end of the day anyway…why not let it go into tummies instead of dumpsters?!!
